Additional legislation to bring drug – driving in line with drink driving penalties has been postponed to march 2nd next year. Legal limits will be introduced in relation to eight illegal drugs, including cocaine and heroin together with eight legal medicines. This takes the emphasis off the impairment test and places more importance on the legal limit. The legislation takes into account that persons prescribed medication quite often abuse the permitted dose.The new law provides for the medical defence of taking medicine in accordance with instructions which differs from existing law.Nicholas Dearing of DRN said “its important to note that the legal limit varies from drug to drug and it would be advisable for drivers who take prescribed medication to have the instructions to hand if stopped by the police”.
